General Terms and Conditions

The offer, sale, purchase and delivery of products on the website, www.lightstore.co.za (seller), is governed by the following general terms and conditions:
The website will provide information about the main features, materials and functions of each product, its price and shipping costs. Should further information be required by the buyer, the buyer must email lightstore@touchstonelighting.co.za or call (011) 465-5697 for such additional information. It is the responsibility of the buyer to ensure that the buyer has sufficient information before purchasing the products.
English shall be the language to be used to communicate and contract between the seller and buyer.
The buyer, by submitting the order form, automatically accepts, unconditionally, and agrees to understand and to observe the general terms and conditions during the relationship with the seller.
Once the purchase has been made by the buyer, the seller shall send to the buyer, through electronic mail, a confirmation receipt of the order.
The main characteristics, functions, purposes, capabilities, materials and other relevant information of the products are shown on the website on each “product page”. No guarantees whatsoever, expressly or implied, other than those specifically mentioned on the website are given by the seller to the buyer.
Purchase requests from countries other than South Africa should be emailed directly to lightstore@touchstonelighting.co.za.
Payment will only be accepted by credit cards, debit cards and EFT’s via Payfast or direct bank transfers. All financial information will be sent by encrypted protocol to PayFast, which provides a secure electronic payment services to the seller. This information will not be used by the seller except for performing the procedure relevant for the proper fulfillment of the order. The privacy of the buyer is of utmost importance to the seller. Please refer to our privacy policy.
The price for the purchase of products and the shipping costs, as indicated on the order form, will be charged to the buyer’s bank account upon purchasing of the products by the buyer on the website.
Ownership of the products shall at all times remain vested in the seller up until such time as the total purchase price for the products have been paid in full (to the satisfaction of the seller).
Where required, the seller shall deliver the products ordered and paid for by the buyer via a reputable third-party courier services.
The Seller will deliver, via the courier service, the products as soon as reasonably possible (generally within 7 days), but no later than 14 days of receipt of payment (“delivery period”) unless otherwise agreed. (The buyer must take note of lead times for certain products such as imports and custom fittings.) In the unlikely event that the seller is unable to deliver the products, for whatever reason out of its control, within the delivery period the buyer will then be notified timeously. The buyer may then elect to (a) wait for the product to be back in stock (b) purchase alternative products (c) cancel the order for the products and the seller shall reimburse the full purchase price and shipping costs paid by the buyer.
The seller’s obligation to deliver any products is completely fulfilled when the purchased products are delivered at the physical address nominated by the buyer in the order form, or the buyer collects the products from the sellers premises.
In the unlikely event that any products ordered by the buyer from the seller were not successfully delivered to the buyer’s delivery address within the delivery period, then the buyer must notify the seller in writing at lightstore@touchstonelighting.co.za. The seller shall following receipt of a notification as aforesaid verify the information provided by the buyer against the delivery records of the seller. If determined by the seller that all or part of the products ordered were indeed not successfully delivered, the seller will process and deliver such non-delivered products as soon as reasonably possible.
In the unlikely event that you receive a defective or damaged product please contact us within 48 hours of delivery of the goods. You may contact us via email at lightstore@touchstonelighting.co.za or telephonically on (011) 465 5697. Once we receive your communication and validate the claim we will make arrangements to collect the damaged products. Products received by the buyer with broken / cracked glass or dented shades are not considered defective and in these cases the seller will deliver a replacement piece ASAP. The seller will not accept any responsibility or liability for any damages not reported, by the buyer, within the 48-hour time frame.
The seller may, at its discretion, accept returns of certain products within a maximum of 7 days of the delivery of the products. The seller will consider the reasons for the return and advise the purchaser accordingly within 24 hours of such request. In the event that the seller agrees to accept
the products being returned a 25% handling fee will be charged. Furthermore, the following applies to any returns accepted by the seller:
• The purchaser will be responsible for the shipping costs of the products over and above the handling fee.
• Goods must be retuned within 7 days of delivery.
• Products must be in as new condition, unused, undamaged, in original packaging, no damages to packaging and all booklets / leaflets must be inside packaging.
• The seller will not accept any returns which have not been previously agreed to in writing.
• The seller will not consider or accept returns of the following product: Lamps / globes, specifically imported products, custom made or modified products, batteries, discounted products, LED strip light, drivers and transformers.
The purchaser will pay for the delivery of the products as per the rate automatically calculated at the checkout page. Collections at the sellers premises are free of charge. The delivery fee calculated on the webpage is for deliveries to metro areas in South Africa. Should the purchaser fall outside these areas then the seller will contact the purchaser with details of any extra delivery charges. For deliveries outside of south Africa please email lightstore@touchstonelighting.co.za.
The seller shall not be liable for any direct, indirect, special or consequential damage, loss, or injury which the buyer may suffer from or arising out of any cause whatsoever from the products purchased or for the use of the website. The buyer hereby indemnifies the seller from any and all claims for damages, loss or injury arising from the buyer’s use of the website or any of its products offered or sold on the website unless otherwise expressly provided by law.
This website is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law and the buyer and seller submit to the jurisdiction of the South African courts.
The buyer agrees to receive occasional marketing and / or general communication from the seller via email.
